TERMS & CONDITIONS

1.  Introduction

1.1. DLB applies to the terms ‘DLB’, ‘David Lewis-Browne Framers & Gilders’, ‘DLB Framers & Gilders’, and ‘DLB Fine Art Photography’.

1.2. ‘Client’ refers to you, our customer, who buys from:

  • DLB’s Wynberg Studio
  • or from our website and secondary suppliers.

1.3. If there is anything that is unclear please ask us to explain it before you accept these Terms and Conditions.

1.4. We may amend these Terms and Conditions, at our sole discretion, from time to time.

2.  General T&Cs

2.1. The Client is asked to note that all items for framing are accepted by DLB on the basis that we do not accept responsibility for the loss or damage of them howsoever caused whilst:

  • in the framers’ studio
  • in transport
  • or otherwise in the framers’ care.

2.2. The Client is advised to arrange such insurance as he thinks appropriate in respect of these risks.

2.3. Framing will only commence on the receipt of acceptance of the quote.

2.4. Quotes exceeding a value of R10 000 will require a 50% deposit.

2.5. Our turnaround time is 2 – 3 weeks from quote approval date.

2.6. All orders are COD (refer to Section 5).

2.7. DLB also reserves the right to photograph the completed works for archiving and promotional purposes.

3.  Quotes

3.1. Framing orders are only actionable on the receipt of an approved quotation.

3.2. Quotations are valid for 30 days from date of quote.

3.3. The quotation is accordingly subject to the ruling exchange rate on the date of order and the quotation may vary accordingly.

3.4. Where applicable, availability of the goods quoted for is subject to the availability from the South African distributors of these goods.

4.  Invoices

4.1. VAT will be raised for the hardware and implementation of services to complete  the order.

4.2. All invoices will be subject to the Terms and Conditions hereof unless specifically stated otherwise.

5.  Payments

5.1. Payments are strictly COD.

5.2. Clients can pay via EFT and proof of payment emailed to dlb@dlewisbrowne.co.za.

5.3. Alternatively, credit card facilities are available.

5.4. Should any amount not be paid by the Client on the due date, the Client will be liable to pay interest in respect of the amounts unpaid as at the due date at the compound rate of 2% above the prime rate, per annum.

5.5. Discounts will no longer apply to overdue amounts.

6.  Discounts

6.1. Discounts are solely at the discretion of DLB on a per order basis.

6.2. Preferential considerations for discount apply to artists, galleries and established custom relations.

7.  Delivery & Collection

7.1. Refer to Section 2.1. While every precaution will be taken, DLB assumes no liability  for any loss or damage in delivery. Delivery is offered on specific request only.

7.2. The Client is to take out the necessary insurance as of the purchaser.

7.3. Clients wishing to use DLB’s collection and delivery service do so at their own risk.

7.4. All completed frames are checked before leaving DLB but the onus is on the Client to inform DLB immediately on receipt of the works of any damage in transit.

7.5. DLB is not liable for any third party damage caused by the handling of the works in the case of third party couriers and other third party handling.

7.6. Frames not collected within 6 months of invoicing will incur an additional 10% on the invoice cost.

7.7. DLB reserves the right to recoup any costs incurred on frames not collected on a discretionary basis.

8.  Delays

8.1. DLB will inform the Client in the event of impossibility or delay due to circumstances entirely beyond the control of DLB.

8.2. DLB will inform the Client as soon as they become aware of impossibility or delay in the supply.

9.  Returns / Dissatisfaction

9.1. The onus is on the Client to immediately inform DLB of any concerns that may arise concerning the quality of framing or issues deemed to be related to the brief and outcomes.

9.2. All queries will be considered for the best possible outcome for both the Client and DLB.

 10.  Cancellation

10.1. Should the Client cancel the order after accepting the quote, DLB is entitled to charge for set-up costs, charged at 2 – 5% of the quote depending on the stage of cancellation.

11.  Privacy and Security

11.1. DLB does not disclose any of your personal details to other companies or individuals. We do not keep a record of, or store, any part of your card details.

11.2. DLB reserves the right to photograph the completed works for archiving and promotional purposes.

12.  Website

12.1. The contents of the website are protected by law, including but not limited to copyright and trade mark law. The website content is the property of DLB or sponsors and/or is approved for use by DLB.

12.2. Any use, distribution or reproduction of the website content is prohibited unless expressly authorised by DLB. To obtain permissions for the commercial. use of any website content, please contact us.
